These Terms & Conditions govern your use of FreshExe QR (the “Service”), available at qr.freshexe.com and qrcode.freshexe.com. The Service is provided by Fresh Streams Works Ltd. (“we”, “us”, “our”). By creating an account, generating a QR code, or otherwise using the Service, you enter into an agreement with Fresh Streams Works Ltd. and agree to these terms. If you do not agree, please do not use the Service.
1. The Service
FreshExe QR is a web application that generates QR codes for links, plain text, WiFi credentials, email addresses, phone numbers, SMS messages and contact cards, and that hosts optional anonymous message inboxes reachable by link or QR code. A free tier is available, and a paid “Pro” subscription unlocks additional limits and features described on our pricing page.
2. Eligibility and your account
You must be of legal age in your jurisdiction to enter into a contract, and if you are using the Service on behalf of an organisation you confirm you have authority to bind that organisation. You are responsible for the accuracy of the information you provide, for keeping your account credentials confidential, and for all activity that occurs under your account.
3. Acceptable use
You agree not to misuse the Service. In particular, you must not:
- use the Service for any unlawful, fraudulent or deceptive purpose;
- encode links to malware, phishing pages, or content that infringes the intellectual property or privacy rights of others;
- send spam, harassment, hate speech, threats or unlawful content through anonymous inboxes;
- interfere with or compromise the security of the Service, including probing, scanning, scraping, or circumventing plan limits or technical restrictions;
- reverse engineer, resell, or redistribute the Service.
Anonymous inboxes are provided as a communication tool. You are responsible for how you share your inbox links and for moderating the content you receive. We may remove content or disable an inbox that is used unlawfully or abusively.
4. Intellectual property
Fresh Streams Works Ltd. retains all rights, title and interest in the Service, including its software, design, documentation and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with your plan. QR codes you generate and the content you encode remain yours; you grant us only the limited licence needed to host and process that content in order to provide the Service.
5. Payments, subscriptions and Merchant of Record
Pro subscriptions are billed monthly or annually in advance at the prices shown on our pricing page, and renew automatically until cancelled. You may cancel at any time; access continues until the end of the period you have already paid for.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax and cancellation mechanics are additionally governed by Paddle’s Buyer Terms. Refunds are described in our refund policy.
6. Service availability
We work to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. Features, limits and plans may change, and we may perform maintenance that temporarily affects availability.
7. Suspension and termination
We may suspend or terminate access where there is a material breach of these terms, non-payment, a security or fraud risk, or repeated or serious policy violations. You may stop using the Service and delete your data at any time. On termination, saved QR codes, inboxes and messages associated with the account may be deleted.
8. Warranties and liability
To the fullest extent permitted by law, the Service is provided “as is” and we disclaim all implied warranties, including merchantability and fitness for a particular purpose. Our aggregate liability arising from or relating to the Service is limited to the fees you paid in the twelve months preceding the claim. We are not liable for indirect, consequential or special damages, including loss of profits, data or goodwill. Nothing in these terms excludes liability for fraud, death or personal injury where such exclusion is not permitted by law.
You agree to indemnify Fresh Streams Works Ltd. against claims arising from content you encode or receive, your unlawful use of the Service, or your breach of these terms.
9. Governing law and changes
These terms are governed by the laws of the jurisdiction in which Fresh Streams Works Ltd. is established, and disputes are subject to the courts of that jurisdiction. We may update these terms; material changes will be reflected by the “last updated” date above, and continued use of the Service constitutes acceptance.
